By creating a MathMate account or using MathMate ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you use MathMate on behalf of a school, district, or other organization, you represent that you have authority to use the Service on that organization's behalf and to comply with these Terms.
You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for activity that occurs under your account.
Each individual account is intended for use by one person. Sharing credentials to provide access to unauthorized or simultaneous users is not permitted.
Users must be legally able to enter into a binding agreement. MathMate accounts are intended for teachers, school staff, and administrators, not for direct student use.
MathMate may offer limited free access, free features, promotional access, or trials from time to time. The features, topics, duration, and eligibility for free access may change and will be described in the Service when offered.
Paid subscriptions are billed in advance on a recurring monthly or annual basis, as selected at purchase, through Stripe.
If a promotional trial requires a payment method or automatically converts to a paid subscription, those terms will be disclosed before you begin the trial. If a trial does not automatically convert, that will likewise be disclosed.
You may cancel a recurring paid subscription at any time. Unless otherwise stated at purchase, cancellation stops future renewals and access continues through the end of the billing period already paid for.
School and district licenses are governed by the seats, term, price, renewal provisions, and other terms shown at purchase or contained in the applicable school or district agreement.
Except where required by law or expressly stated at the time of purchase, fees already paid are non-refundable. If MathMate makes a billing error, contact admin@mathmate.org so the issue can be reviewed.
You agree not to:
MathMate uses third-party AI services to generate lesson content, practice problems, assessments, images, and related materials based on user inputs.
AI-generated content may contain errors, omissions, or unsuitable material. Users are responsible for reviewing generated instructional content for mathematical accuracy, instructional appropriateness, accessibility, and suitability before using it with students.
You retain rights you already have in the original inputs you provide. Subject to these Terms and any third-party rights, you may use, print, adapt, and share materials generated through your account for your own educational, classroom, and school-related use.
Do not enter sensitive personal information about students into MathMate unless doing so is necessary, authorized by your school or district, and lawful.
MathMate's name, logo, platform, interface, software, design, proprietary prompts and workflows, and other underlying technology and materials are owned by or licensed to MathMate and are protected by applicable intellectual property laws.
Except for the rights necessary to use the Service as intended, these Terms do not grant users ownership of MathMate's trademarks, branding, software, source code, or underlying technology.
A school administrator who purchases or manages a license may be able to view teacher account and seat status, add or remove authorized seats, and manage the organization's subscription.
Blocking or removing a user's access does not necessarily cancel or change the organization's billing arrangement. Billing changes must be made through the applicable subscription or school-license process.
Schools and districts are responsible for ensuring that their use of MathMate, including any student-related information entered by authorized users, complies with their policies and applicable privacy and education-data laws.
Separate school, district, data-privacy, or purchasing agreements may apply. If a separate written agreement directly conflicts with these Terms, the separately signed agreement will control for the matters it addresses.
You may stop using MathMate and cancel a paid subscription at any time, subject to the billing terms above.
MathMate may suspend, restrict, or terminate access if an account violates these Terms, is used fraudulently or abusively, creates a security risk, or threatens the operation of the Service or other users.
When reasonably practicable, MathMate will provide notice before terminating access for a non-urgent violation.
The Service is provided on an "as is" and "as available" basis to the extent permitted by law. MathMate does not guarantee that the Service will be uninterrupted, error-free, or available at all times, or that AI-generated content will be accurate or suitable for every instructional purpose.
MathMate is a supplemental instructional resource and does not replace a teacher's professional judgment, a school's adopted curriculum, required accommodations, or applicable instructional and assessment requirements.
You are responsible for reviewing generated content before use.
To the maximum extent permitted by applicable law, MathMate will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of data, revenue, profits, or business opportunities arising out of or related to use of the Service.
To the maximum extent permitted by applicable law, MathMate's total liability for claims arising out of or relating to the Service will not exceed the amount you paid to MathMate for the Service during the twelve months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations or exclusions of liability, so some of the limitations above may not apply to you.
MathMate may modify features, pricing, free-access options, or other aspects of the Service from time to time.
We may also update these Terms. If material changes are made, we will update the "Last updated" date and, when appropriate, provide notice through the Service or by email. Continued use of the Service after updated Terms take effect constitutes acceptance of the revised Terms.
These Terms are subject to applicable federal, state, and local law. Nothing in these Terms limits any consumer or other legal rights that cannot lawfully be waived. Any dispute will be handled in accordance with applicable law and any separate written agreement between MathMate and the relevant user, school, or district.
